Terms of service.

Plain English summary. When you use Elitesgen, you are agreeing to use it in good faith: to follow the community guidelines, to not attack other people, and to treat the platform with the same care you would want from others. The core is free and will stay free. We do not run ads. We do not sell your data. You can leave at any time and take your data with you.

Who is providing the service

The Elitesgen services are operated by Elitesgen, Inc. under license from its parent, Elites Generation Foundation, Inc., a nonprofit foundation (501(c)(3) pending). The mission, the brand, and the charter commitments belong to the Foundation. The product, the engineering, and the day-to-day operations belong to the subsidiary.

Both entities are bound by these terms.

Your account

To create an account, you must be at least thirteen years old. If you are between thirteen and fifteen, you must have verifiable consent from a parent or guardian. If you are sixteen or older, you can create an account on your own.

You are responsible for keeping your account credentials secure. If someone else accesses your account without your permission, tell us at security@elitesgen.org.

You can have one account at a time. Creating multiple accounts to evade a ban or to manipulate community systems is a violation of these terms.

Acceptable use

What is and is not allowed on the platform is described in detail on the acceptable use page. In short: treat people with care, do not harass anyone, do not use the platform to harm anyone, and do not try to abuse the systems we use to keep people safe. Enforcement, appeals, and the tiered response ladder are documented on that page.

Content you post

You own what you post. Your messages, your writing, your uploads, your Circle memories. They are yours. You can export them at any time and you can delete them.

By posting on Elitesgen, you grant us a license to store, display, and transmit that content for the sole purpose of operating the service the way it is supposed to work. We do not claim ownership. We do not relicense your content to third parties. We do not use your content to train third-party AI models.

If you delete your content, we delete it, on a documented schedule. Backups are purged within thirty days.

Content we show you

Editorial content we publish (essays, announcements, guides, community content we curate) belongs to the Foundation or its contributors. You can read, quote with attribution, and share it under normal fair-use conventions.

We moderate content that violates the acceptable use policy. Moderation is done by paid human moderators with clinical oversight where appropriate. We do not rely on automated systems alone for enforcement actions with lasting consequences.

Paid features and membership

Core features are free, forever. Membership tiers (Sustaining Member, Founding Member, Supporter) are ways to support the work. They never gate essential access. What you get at each tier is listed on the membership page.

Recurring memberships can be cancelled at any time, for any reason, from your account settings. If you cancel, your membership continues through the end of the current billing period; we do not prorate refunds for partial periods, but we will make exceptions for mistakes and circumstances that warrant them. Just ask.

We will never manufacture urgency, hide a cancel button, or confirm-shame you out of leaving. If you want to downgrade to the free tier, you are still fully a member of the community.

Intellectual property

The Elitesgen name, the Elites Generation Foundation name, the Egen sub-brand prefix, the logos, the design system, and the software are owned by the Foundation and licensed to the subsidiary for operation. You cannot use them to suggest endorsement of your product or service. Editorial and press use is welcome; see the press page for the kit and attribution guidance.

Termination and leaving

You can close your account at any time, for any reason. We will help you export your data before you go. Account deletion is honored with real work; reference the data practices page for retention windows and what gets purged when.

We can terminate an account for a serious or repeated violation of these terms or the acceptable use policy. Termination decisions can be appealed; the appeals process is on the acceptable use page.

Disclaimers and liability

Elitesgen is a community platform. It is not a substitute for medical care, mental-health treatment, crisis intervention, or legal advice. The companion is an AI feature designed to support reflection and community; it is not a therapist and does not make clinical claims. If you are in crisis, contact local emergency services or a crisis line.

We work hard to keep the service running and safe. We do not, however, guarantee specific outcomes, uninterrupted access, or results from using the platform. Where the law allows us to limit liability, we do.

Disputes

If something goes wrong, write to us first at hello@elitesgen.org. Most things can be fixed with a conversation, and we would rather fix them than fight about them.

If a dispute cannot be resolved informally, it will be resolved by binding arbitration, seated in Delaware. We do notimpose a class-action waiver. You keep the right to participate in a class, and we keep the right to defend the platform transparently, in public, when the claim is about the platform's practices.

Changes to these terms

If we change these terms, we will publish a notice on the announcements page at least thirty days before the change takes effect, unless the change is required by law to be faster. We will tell you in plain English what changed and why.

Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Incorporation in Delaware is forthcoming; the governing-law clause will be confirmed at filing.

The privacy policy explains what we collect, why, for how long, and what you can do about it. Both documents are in plain English, and both are binding.
